New superannuation ban over 'predatory' tactics after $1 billion collapse

Australia's financial regulator is introducing stricter measures to curb aggressive and misleading practices in the superannuation industry, following the high-profile collapse of a fund that left thousands of members out of pocket. The new regulations, announced this week, are designed to stop what officials describe as "predatory and inappropriate behaviour" by financial advisers and fund managers.

The move comes after a $1 billion fund failure that exposed significant gaps in consumer protections. Investigators found that some advisers used high-pressure sales tactics, encouraged members to switch funds unnecessarily, and failed to disclose hefty fees. In several cases, vulnerable Australians, including those nearing retirement, were steered into high-risk products without proper warnings.

Under the new framework, superannuation trustees will be required to monitor adviser conduct more closely. They will also have to report any suspicious patterns, such as a sudden spike in rollovers or transfers into a single fund. Penalties for breaches will increase, with fines reaching into the millions for repeat offenders. The regulator has also flagged that it will fast-track bans for advisers found guilty of misconduct, rather than allowing them to continue operating during lengthy appeals.

Industry groups have largely welcomed the changes, though some warn that tighter rules could add compliance costs. Consumer advocates argue the measures are long overdue, pointing out that many victims of the collapsed fund were never fully compensated. The new rules are expected to take effect within six months, giving funds time to adjust their systems. For now, the regulator is urging anyone who suspects they were targeted by aggressive sales tactics to come forward and lodge a complaint.
